A New York woman who claims she was trampled and suffered a broken elbow amid the chaos in the November shooting at the Garden State Plaza has filed a lawsuit against the mall's owner, the gunman's estate and his brother who owned the weapon.
Alexandra DiMarco, 21, of Tappan, N.Y., claimed in a lawsuit filed in Hackensack Superior Court she was knocked to the floor during a stampede when shots rang out on Nov. 4, according to NorthJersey.com. DiMarco said she broke her elbow and suffered cuts and bruises.
No one was shot when Richard Shoop, 20, of Teaneck, entered the mall dressed in all black and carrying a modified Sig Sauer rifle that appeared like an AK-47. Shoop opened fire, but struck no one.
Shoop remained at-large and was later found in the mall's basement where he committed suicide by shooting himself in the head.
DiMarco's lawsuit claims mall security was "careless and negligent" because Shoop wasn't stopped when he entered the mall dressed in all black, wearing a motorcycle helmet and carry a rifle, NorthJersey.com reported.
DiMarco's suit names Westfield Garden State Plaza, Shoop's estate and his brother, Kevin, who owned the gun, the article said.
